Terms of Service
Effective October 8, 2026
These terms are an agreement between you and GlueGroups, Inc. (“Kite,” “we,” “us”). Questions about them go to hello@kite.bot.
These terms cover your use of the kite.bot website and of the Kite apps for Mac and iPhone, including pre-release (alpha) versions. By requesting access, downloading, installing, or using Kite, you agree to them. If you use Kite for an organization, you confirm you can bind it. If you don’t agree, please don’t use Kite. Our Privacy Policy explains how we handle data and is part of these terms.
1. The alpha program
Kite is early, unfinished software, offered to a limited group of testers. During the alpha:
- It may be buggy, change or break without notice, lose data, or stop working. Don’t rely on it for anything important, and keep your own backups.
- We may limit, suspend, or end access, or end the program, at any time.
- Features, pricing, and these terms can change. We may charge for Kite later; we won’t charge you for the alpha without your agreement.
- We might invite you to give feedback. You’re not required to.
2. Access and your account
Access is by invitation, and we decide who gets it. Alpha access is personal to you and can’t be shared, sold, or transferred. Keep any credentials, API keys, and TestFlight or download links we send you private. You’re responsible for activity under your installation.
3. Confidentiality
Alpha builds, unreleased features, and non-public information about Kite are our confidential information. Don’t publish, screenshot for public posting, or share them without our written permission, unless we’ve told you something is public. This doesn’t cover information that’s already public, that you knew before, or that you’re legally required to disclose. Talking about the fact that you use Kite is fine.
4. License
While your access lasts, we grant you a limited, non-exclusive, revocable, non-transferable license to install and use Kite for your own personal or internal evaluation. Our rights in Kite stay with us. You may not copy, sell, or distribute Kite, reverse engineer it (except where the law allows it despite this restriction), remove notices, or use it to build a competing product or to harm others. Kite includes open-source and third-party components that carry their own licenses.
5. Your content and your bots
You own your content: your messages, files, and the output your bots produce. Kite keeps it on your devices, and we don’t claim any rights in it. You give us only the permissions needed to process it on your devices as you direct.
Kite connects to AI providers, agent systems, and tools that you choose and configure. You’re responsible for those relationships: their fees, their terms of use, and their handling of your data. Your use of a provider with Kite must comply with that provider’s terms. We don’t operate, control, or guarantee them, and we’re not responsible for what they do with your data.
6. Agents act on your behalf, so supervise them
Kite bots are AI agents. They can run commands, edit files, browse the web, operate apps on your Mac, use connected services, and, if you set them up, run on a schedule without you watching. AI output can be wrong, incomplete, or unsafe, and an agent can take actions you didn’t intend.
You are responsible for the permissions you grant, the routines you schedule, the tools you connect, the actions you approve, and what you do with a bot’s output. Review approvals carefully, start with narrow permissions, keep backups, and don’t point a bot at systems, accounts, or data where a mistake would be costly. Don’t use Kite for high-risk purposes such as medical, legal, financial, or safety-critical decisions without independent review.
7. Acceptable use
Don’t use Kite to break the law or others’ rights; to attack, probe, or disrupt any system you don’t own or have permission to test; to generate or distribute malware, spam, or harmful or deceptive content; to bypass the limits or safeguards of a provider or of Kite; or to interfere with the alpha or our services. We may suspend access for violations.
8. Feedback
If you give us feedback or ideas, you grant us a perpetual, worldwide, royalty-free right to use them to improve Kite without owing you anything or attributing you. Don’t include personal or confidential data of others in feedback.
9. Privacy and diagnostics
You agree that the distributed apps send us diagnostic data as described in the Privacy Policy so we can run and improve the alpha.
10. No warranty
Kite is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We make no promise that Kite is secure, that it won’t lose data, or that bot output is correct. Some places don’t allow some of these disclaimers, so they apply only as far as the law permits.
11. Limit of liability
To the fullest extent the law allows, we aren’t liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, or for the cost of replacement, arising from your use of Kite, even if we were told they were possible. This includes anything a bot, a provider, or a connected tool does. Our total liability for any claim relating to the alpha is limited to US$100. These limits don’t exclude liability that the law doesn’t allow us to exclude.
12. Indemnity
You’ll defend and cover us against third-party claims, and related costs, arising from your content, your bots’ actions that you configured or approved, your breach of these terms, or your misuse of a third-party provider.
13. Ending
You can stop using Kite and delete it at any time. We can suspend or end your access at any time, with or without notice. Sections 3, 5 (your responsibility for providers), 8, 10, 11, 12, 14, and any others that by nature should survive, continue after termination.
14. Governing law and disputes
These terms are governed by the laws of California, without regard to conflict-of-law rules. Courts in San Francisco County, California have exclusive jurisdiction, and you consent to them. If you’re a consumer with mandatory rights where you live, nothing here removes them.
15. Changes and general terms
We may update these terms; the new version applies once posted, and continuing to use Kite means you accept it. If you disagree, stop using Kite. These terms and the Privacy Policy are the whole agreement between us about Kite. If part is unenforceable, the rest stays in effect. Not enforcing something isn’t a waiver. You can’t assign these terms; we can.
